Youth , 19 , Charged Wit h Assaulting Off-Dut y Policeman MASTIC BEACH—A 19-year- old Middle Village youth p leaded not guilty Monday to committing third degree assault Sunday here and will be tried October 9 before Brookhaven Town Justice Leon E. Giuffreda in Patchogue. The complainant , Victor F. Vil- lacara , a Fifth Precinct police pa- trolman, charged Robert Anello of Juni per Valley Road , Middle Vil- lage , with thiid degree assault . The patiolman told police that he was off dut y when the incident occuried at the Beachcomber ta- vern here. He said he was sitting with a friend , John Dawson of Noith Bell port , when the defend- ant threatened to fight him , ac- cording to police. Police said Mr . Villacara told them the Anello youth struck him in the mouth and Le placed the defendant under arrest about 1 :30 a. m. Sunday. Anello was released in $50 bail for his arraignment Monday be- fore Justice Giuffreda in Patch- ogue. The justice said the defend ant' s request for a jury trial was g ranted. Sand and Stone Coi poiation to change he zoning of its Manorville pro- ] ertv from \C\ residential to \L-\\ Industrial , at 7:30 p. m. August 15 at Town Hall , Robert A. Cooney. Brookhaven Town Clerk , has announced. Long a source of antagonism to a large segment of Manorvil' e re- sidents , the sand pit , loc l '- ed on South Stieet west of Wading Ri- ver Road, has been dormant s.nce 1 958 , when the zoning board of appeals rejected a request b y the corporation for an extension ' »f its two year permit to remove sund and stone from the 85-acre pro- perty. Objections voiced by Manorvi'le. lesidents range from the be ' ief that if the sand p it resumes c per- ation. it will become an \ attrac- tive nuisance \ or dangerous temptation to children , to the fact that dust will be raised on South Street by the corporation ' s heavy equipment. If the variance is granted, how- ever , town ordinance providj s tnat South Street must be oiled by tne corporation to keep dust to a min- imum and that excavation at the pit will be under the supervision of the building inspector.
