3 East Patchogue Men Dra w Sentences in County Jail Three Fast Patchogue men , Daniel Dennis Derby, Richard Barth- elme-s ai'd Leo Joseph Barthelmess , were sentenced to count y jail terms Friday b y Patchogue Police Justice Arthur Mapes after enter- ing pleas of guil ty to charges arising from incidents in two Patch- ogue taverns . •> —— Third degree assault , resisting arrest , disorderly conduct and maliciou s mischief were the charge. - , in the case arising from the beating of persons ami de- structi on of property in June at the Ma-cot Pavilion ' at (>00 South Ocean A\enue. Defense Attorney George E. Leohtreekor of Patchogue said . \The charges are a little heavy, but we will not quarrel with them. \ After his clients had changed tlo ir p leas of innocence to pleas of guilt y, Mr. Lech- trecker urged the police justice to \temper justice with mercy. \ He said he thought the men should receive suspended sentences. Following a recess Justice Mapes imposed the sentences recommended b y Mr. Feuer , the prosecuting attorney. Ht 1 was required to make restitution of $80 to Harry Kousi , proprietor of the Mascot. Derby was placed on probation for three years with the conditions of probation being that he would abstain from alco- holic beverages and report to the Suffolk County probation o fficer. Derby p leaded guiltv to the fol- lowing charges: Resisting arrest , brought b y Police Lieut. Josep h Hawkins; third degree assault, brought by Alfred Filersen , fifi , of Mulford Street , Canaan Lake , and his son , Edward , ' .VA . same ad- dress; third degree assault , ma- licious mischief and disorderl y conduct, all brought by Mr. Kou- si. and d i s o v (1 e r 1 y conduct, brougl t bv James MoGroary, manager of the Riverside Hotel. Mr. Feuer said he was withdraw- ing- a disorderl y conduct charge , brought b y Police Lieut. Josep h Hawkins, because , he said , it was a duplication of the charge filed by Mr . Kousi. The Eilersens were patrons at the Mascot . Richard Barthelmess . 27, of 28 Log Road , Fast Patchog'ti e , also received a 60-day count y jail sentence on each charge with the sentences to run concurrentl y, and was placed on probation for three years. Conditions of the probation were that ho abstain from use of alcoholic beverages and report to the county proba- tion o fficer. He was also required to make restitution of $80 to Mr. Kousi. Charges against Richard Ravth- elmess to which he p leaded guil- ty, were : Third degree assault , brought b y Peter Si ggelakis , ol , of 600 South Ocean Avenue , and b y Frederick J. Welsh of 27 North Prospect Avenue , Patch- ogue. a patron at the Riverside Hotel; disorderly conduct, brought by Mr. McGroary, and malicious mischief and disorderly conduct , brought by Mr. Kousi. Mr. Feuer told the' justice he was withdraw- ing the disorderly conduct charge , b ' ought bv Fifth Precinct Pa- trolman Horace Giuffrida , be. cause of dup lication with Mr. Kousi ' s similar charge. Mr. Sig- gelakis is a cook at the Mascot. Loo Josep h Barthelmess , 24 , of lf>< ; Munsell Road . Fast Patch- ogue. was sentenced to '50 days in county jail on each charge with the sentences to run concurrent- Is. He was required to make- re- stitution of $80 to Mr. Kousi. Also , he was p laced on probation for three years. Conditions ol probation were' that he abstain from alcoholic beverages and re- port to the county probation of- ficer. Charges which Leo Barthel- mess faced were : Third degree assault , broug ht by Edward Eil- ersen; malicious mischief and dis- orderl y conduct , broug ht by Mr. Kousi , and disorderl y conduct , brought by Mr. McGroary. Mr. Feuer told the justice he was with- drawing the disorderl y conduct e barge , broug ht by Patrolman Giuffrca , because , he said , it con- stituted a dup lication of the dis- i rderly conduct charge filed by Mr. Kousi. There were seven complainants in all , as follows: Police Lieut. Joseph Hawkins , Alfred and Ed- ward Eilersen , Harry Kousi , James McGroary, Peter Siggela- kis and Frederick J. Welsh. Justice Mapes sti pulated at the request of Mr. Lechtrecker that restitution at the rate of $10 per the three defendants could pay the month. Tn making his recommendation on sentences , Mr. Feuer spoke of the $80 to be paid by each defen- dant to Mr. Kousi as a \fine. '' Mr. Lechtrecker objected and submit- ted that it should be called a \ re- stitution \ for the damage which the men caused at the Mascot. Justice Mapes accepted the posi- tion that the payment should be described as a \ restitution. \ Lechtrecker ' s Statement Tn his statement to the court before sentencing, Mr. Lech- trecker said the defendants real- ized that \ what they have done has been breaking the rules . \ He urged the justice to consider that Ids clients '' are not professional hoodlums. \ Criticizing the press , the de- fense attorney said , \The news - papers have not been generous in the treatment of this situation. \ \The defendants are willing to serve their penalty , \ continued Mr. Lechtrecker. \ \They have broad shoulders . We adults have an obligation to show sympathy to young people when they get in trouble. \ Mr. Lechtrecker said to the justice , \The threats which you. received did not come from this side of the fence; everybod y re- ceived threats and we hope this will end those threats. \ He re- ferred to the telephone threats which were reported by Mr. Mapes to the police to have been made to his home in July. According to police , Mr. Mapes told them per- sons telep honed to say they would burn his home if the justice im- posed jail sentences upon the de- fendants. Feuer ' s Reply \The defendants have made use of their broad shoulders against the people of Patchogue , \ the pro- secuting attorney said. \There has not been a similar incident in the last five years which has caused as much interest . in the town. Peop le feel that the elefendants took advantage of their youth in committing assault upon persons. \ At this point Mr. Feuer made his recommendations for sentencing. Maximum punishment under state law is one year in prison for each of the charges of third de- gree assaul t , malicious mischief and resisting arrest—all misde- meanors. Justice Mapes, said violation of probation conditions by any of the defendants \ would result in the maximum -sentence of one year on the misdemeanor charges. \ CONFISCATED WEAPONS—Suffolk County Police Commissioner Charles R. Thorn has urged patrolmen to halt illegal use of air riflies and pistols . Deputy Chief Inspector A. C. Kohler , left , chief of uniform force , and Sgt. Thorn Seeks to Halt Illegal Use of Air Guns An increase in vandalism , attri- buted to juveniles using air guns , has resulted in the issuance' of an order b y Commis. -doner Charles R. Thorn to Suffolk Count y patrol- men to seek out and apprehend all persons using air rifles and pis- tols illegall y, and to confiscate the weapons. The Police Department said it feels that parents are unaware that the law forbids sale of air , spring and compressed gas type of weapons to persons under 1(5 years of age , and have perhaps unwittingly provided their children with these dangerous weapons. Such weapons are capable of j throwing projectiles with suffici- ent speed to inflict serious bodily injury, should they strike in a soft tissue area, such as the eye. The Penal Law makes it a misdemean- or for anyone to offer , sell , loan , lease or give any such weapon or ammunition to a child under 16 years of age , the police said , and the Penal Law also provides that any child under the age of 16 who shall have , carry or have in his possession one of these weapons shall be adjudicated a juvenile de- linquent. The commissioner urged parents storekeepers and others to cooper- ate with the Police Department to protect the persons and property of the peop le of the county and summer visitors.
