Prize Winners In Home Decor. Contest Named Prize winners in each of the five districts of the outdoor Christmas Home Decoration Con- test conducted by the Patehogue Chamber of Commerce were an- nounced this week. J udges were members of the Patehogue Civic and Garden Club. The largest number of persons ever to enter were in the program this year — li\ -;- ' . First prize was f y 0 , second . &W , and third . $20. This was in each of the five dis- tricts — a total of $500. Norman W. Roe of East Pat- chog-ue made possible this enlarg- ed program by donation of the prize money. Humphrey R. Avery gave the chamber substantial help in putting on this Christmas event. The chamber thanks everyone who helped in making this Christ- mas decoration contest a success. The lights will be left on until New Year ' s so those who would like to see the display can do so. Barron Hill dismiss- in <*: a suit against l' roukhas'en Town Kuilding Inspector Emil Lange. The statement was made re- cently h y .John .1. Mart Jr., of Bellport , ationiey of the Pateh- ogue law i' u ni of Pellotreau & Pelletreau. who is representing the Patehogue Sunrise Drive-In , Inc., of Merrick , petitioners in the action. The corporation is the owner of ahout 70 acre ; of land on Sunrise Highway in Pateh- ogue and Blue Point. The firm has started several court actions . seek- ing approval of their p lans to huihl an outdoor movie on the site. In his ruling - the justice noted that , the company has two suits against the town still pending in Supreme Court that relate to the same intended use of the property. Permit Application The corporation ' s counsel said that when the- corporation app lied for a building- permit March 17, 1961 from Mr. Lange , Mr. Lange instructed them to gain a variance from the town zoning hoard of appeals. At an April 20 , 1 0(>1 hearing the -\oning board said it had no jurisdiction in the matter and the pe'itioner should apply to the town board for a zoning change from .1-2 to J- . ' ) business , accord- ing to the minutes of the meet- ing. On Tuesday Mr . Lange said the zoning board referred the peti- tioner to the town boa rd because any building or buildings being built for commercial purposes on a site of two or more acres or where the total floor area of the buildings is If) , 000 square feet or more had to be located in a J- ' .i business zone before the May amendment to the zoning ordin- ance. Mr. Lange said it would be impossible to put a drive-in in J-2 because one would need more than two acres . In its suit the petitioner con- tended further in briefs submit- ted to Justice Hill that the drive- in company had been \ misled\ in being directed to the zoning board and that the building permit should have been granted for con- struction of the theatre in a J-2 zone before the town board in May, 19(51 amended the zoning ordinance to require that drive-in theatres he placed in areas zoned J-3. Denial by Mr. Lange Reached at his office , Mr. Lange denied that he had misled the pe- titioner. He said that before the May amendment , the ordinance required zoning board approval of any app lication to build in a J-2 or J-l zone for a business to be used for amusement. The same procedure would follow* for a ga- rage or service station , he said. \Under the amended ordinance , \ Mr. Lange continued , \ any struc- ture , mercantile or industrial , that contains more than 15 , 000 square feet of floor area or is located on a site of two acres or more , is considered a commercial center and the petitioners have to apply foi- a change of zone to J-3. \If the building is less than 15 ,000 square feet and the prop- erty is less than two acres in size , \ Mr. Lange went on , \ and the premises are being used for a place of amusement , such as a theatre or go-kai*t track, the ap- p lication requires approval of the zoning board of appeal s , even if it is in a J-2 or J-3 zone. \ Representing the town , George E. Lechtrecker , Patehogue attor- ney, contended th e- amended zon- ing ordinance was legal , whereas the corporation said it was \illegal and unconstitutional. \ The justice ruled that the zon- ing ordinance amendment was legally adopted. The petitioner has contended that it has spent $250 , 000 on the p roperty which- adjoins Brook- side Park , a develonment of ex- pensive homes. Mrs. Mattia Greco of 848 South Country Road , East Patehogue , died Saturday at the Brookhaven Mrs. Mattia Greco National Laboratory Hospital af- ter a long illness. Bom in Italy, she was a resi- dent of this area for 17 years. She is survived by her husband , James V.: a son , James and a daug hter , Martha, all of East Pat- ehogue; two brothers , Sal DiGia- como of Brownsville , and Joseph DiGiacomo of Greenwich , Conn . Mrs. Greco was a retired school teacher , who came to East Pat- ehogue in 1944 , and started a business with her husband , known as the Greco Garment Plant , with branches in Patehogue , Islip Ter- race and Seiden.
